Skilled Nursing Facilities Often Fail To Provide Sufficient Care. Are You A Victim?

According to a study conducted by Medicare’s Inspector General, the rate of medical errors resulting in injuries and death in skilled nursing facilities was much higher than that reported for hospitals. Skilled nursing facilities, which include certified nursing homes, typically provide follow-up treatment for patients after they have been discharged from acute care or postoperative care at a hospital and need to recover in an environment outside of the hospital. As reported by the study, medical errors at these establishments are not as widely reported as those that take place at hospitals. Red flags at these facilities are not always obvious. Errors that occurred during patient treatment – including everything from dispensation of the wrong medications to infections – resulted in damages both temporary and permanent, and more than half of the patients who were harmed had to be hospitalized at additional expense. The study also revealed that a majority of these errors were actually preventable. If you or a loved one has been victimized by nursing home errors or wrongdoing, please be aware that you have legal recourses available. At Fenstersheib Law Group, P.A.,…Read More

Road Safety Tips For A New School Year

Officially schools are back in session for students and teachers. This means more congestion, distracted parent drivers and sharing the road with others. School buses are picking up their passengers, kids on bikes are trying to make it on time before the school bell, parents are trying to drop-off their kids to make it to work on time. Most drivers have been used to a lack of children on the streets during the summer, and may fail to realize that now there will be more congestion, that they need to slow down and pay attentions to the little ones on the road. Below are few Road Safety Tips for a New School Year. 1. Walking to school. Be realistic about kids’ pedestrian skills, make sure your children understand that they must walk on the sidewalk, be very cautious around traffic, and must walk facing traffic. If they cross streets on their way to and from school and there is no crossing guard on duty, instruct them to carefully look for cars coming in either direction. Also, impress upon them that they must walk especially carefully around parked…Read More

Is Your Teen Safe Behind The Wheel On South Florida Roadways?

Time flies, and all of a sudden your baby is a teenager and wants to drive. While this thought may inject a combination of pride and fear in the hearts of most parents, as it is the parent’s job to keep their children safe, there are things you can and should do to increase the chances that your teen will be safe behind the wheel. Set guidelines and standards for behavior behind a wheel and outline the ramifications for disregard. Your teen sees a driver license as a step towards independence and freedom, first and foremost, set a good example; drive carefully and show your child how a safe driver operates – if you speed, tailgate, and drive aggressively, your teen probably will as well. Second, make sure your teen completely understands the dangers associated with driving – not only for him but also for his passengers and for the other drivers and pedestrians with whom he or she shares the road. Third, insist that your teen and his passengers wear seat belts every time they are in the car. Fourth, establish a clear set…Read More

Things You Definitely Should Not Do While Driving

Driving requires concentration and abiding civility toward our fellow drivers. It’s estimated that there are around 10 million car accidents every year due to human error and dangerous driving habits. Below we have outlined some alarming driving behaviors. The most important thing to realize about all of them is that everything on the list below, can be accomplished before getting behind the wheel, or it can wait until you get to a place where the vehicle can be safely parked. While you can’t expect everyone to show common sense, we urge you to do everything possible so that you avoid these pitfalls and are never distracted while driving. Texting – No matter how much the danger of texting while driving has been publicized, nationwide reports keep mounting about accidents resulting from this extremely dangerous activity. If you are tempted to check your phone while driving, remember, in the time it takes to check your phone, you just drove the distance of a football field at 55mph. Taking our eyes off the road can be fatal. Talking On A Cell Phone – We’ve gotten so used to the…Read More

Reflections On The 4th Of July

As we celebrated the 243rd Anniversary of our Declaration of Independence, I reflected on how proud I am to be both an American and a Lawyer. While we all laugh at the many jokes constantly directed at the legal profession (and some of them are funny), it is important on every 4th of July to remember that many of our country’s forefathers were lawyers. Indeed, of the initial ten Amendments to the United States Constitution, seven (Amendments 1,2,4,5-8) deal directly with legal right. Four of the five members of our first Continental Congress entrusted with developing the Declaration of Independence were lawyers – Roger Sherman, John Adams, Robert Livingston and Thomas Jefferson. Two of them, Adams and Jefferson, went on to become Presidents of our county. And James Madison, the “Father of the Constitution” and the “Bill of Rights” (and our fourth president as well) was also a lawyer. In fact, 25 of the nation’s 45 Presidents have been lawyers. So I am indeed honored to practice this great profession, and to have the ability to fight for people’s legal rights and those denied the due…Read More

Are You Experiencing Side Effects From Your Prescribed Drugs?

When patients are issued prescriptions for new drugs, ever so often they may experience a reaction from the new medicine. That reaction is commonly known as a side effect. This happens often, and more disturbing than that is the fact that more than likely, many doctors have not been made aware of the possibility of such side effects by the pharmaceutical companies manufacturing the drugs. Indeed, studies have shown that many drug company representatives do not properly inform doctors about the possible side effects of the medications that they are distributing to the physicians’ offices. The lack of medical transparency is very alarming. The research, conducted via questionnaires to doctors in the United States, Canada, and France, reveals that company representatives not only failed to warn doctors about common side effects from the use of the new medications but also failed to warn them about possible contraindications. Moreover, they also neglected to identify the types of patients who should not use the drugs in question. The research indicates that this happened in more than half of the representatives’ visits, in spite of the fact that…Read More

Be Prepared For Hurricane Season In Every Way

The 2019 hurricane season is with us once again, and along with the typical preparations regarding proper shutters, availability of lanterns and batteries, and stockpiling of portable water and canned foods, it is important to make sure your home insurance is in proper order. While storm damage in Florida is covered by the standard homeowner’s insurance policy, not all damage is covered by it (damage caused by flooding is a perfect example), and most people do not know how to get the full amount they deserve after suffering hurricane losses. In many cases, you may even be eligible for recovery of lost wages due to hurricanes. While lost wages are not covered by your homeowner’s insurance policy, depending on where you work your employer might be required to pay you the lost wages. We cannot stress enough how important it is to consult a trusted legal advisor with your claim – many expenses are reimbursable that you might not be aware of, and you might be missing out on money you are entitled to. If you have any concerns about your hurricane insurance, please call…Read More

Memorial Day – Celebrate With A Plan!

Memorial Day marks the beginning of summer. Families and friends gather together for a picnic or barbecue. However, it’s important to celebrate safely, alcohol has become very common at most occasions as a tool to celebrate. Thus please remember, blood alcohol level of 0.08% or more is the qualifier for drunk driving. Much smaller levels can still put people at an increased risk of accidents. Alcohol is a substance that reduces the function of the brain, impairing thinking, reasoning and muscle coordination. One-third of all traffic crash fatalities in the United States involve drunk driving and one person is killed every 51 minutes by a drunk driver on our Nation’s roadways. Remember that it is never okay to drink and drive, even if you’ve had one alcoholic beverage. Have a designated driver, call a taxi, a rideshare provider or plan to use public transportation to get home safely. DUI can set you back thousands of dollars in attorney fees, fines, court costs, lost time at work, higher insurance rates, repairs, and more. So do yourself – and those around you – a major favor: if…Read More
